This Firearms for Sale & Checkout Agreement (“Agreement”) applies to all firearm purchases made through Brady’s Custom Arms (“Company,” “we,” “our,” or “us”), whether initiated online, by phone, or in person. By placing an order for a firearm, serialized receiver, or regulated component, you acknowledge and agree to the terms outlined below.

1. Legal Eligibility to Purchase

By proceeding with checkout, you represent and warrant that:

• You are at least 18 years of age for long guns and 21 years of age for handguns, or as otherwise required by applicable law
• You are legally permitted to purchase and possess firearms under federal, state, and local laws
• You are not prohibited from firearm ownership under any applicable statute
• All information provided during checkout is accurate and truthful

Providing false information during a firearm transaction is a violation of federal law.

All firearm sales are conducted in compliance with regulations enforced by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

2. Shipment to Licensed FFL Dealer Only

All firearms must be shipped to a valid Federal Firearms License (FFL) holder. Firearms will not be shipped directly to a private residence.

Before shipment:

• The customer must select a receiving FFL dealer
• The receiving FFL must provide a valid copy of their license
• The FFL license must be verified

The customer is responsible for confirming that the selected FFL dealer is willing to accept the transfer and for paying any transfer fees charged by that dealer.

Possession of the firearm will only occur after the required background check and paperwork have been completed at the receiving FFL location.

3. Background Check Requirement

All firearm transfers require completion of ATF Form 4473 and a background check conducted by the receiving FFL dealer.

If the background check results in:

Approval – The firearm may be transferred.
Delay – Transfer will occur only if legally permitted after the waiting period.
Denial – The firearm will not be transferred.

If denied, transfer fees and processing fees remain non-refundable. Return shipping or restocking fees may apply.

4. Compliance With State and Local Laws

It is the buyer’s responsibility to ensure that the firearm being purchased is legal in their state and locality.

Orders will be canceled if:

• The firearm configuration is prohibited
• Magazine capacity exceeds state limits
• The buyer fails to meet local permit requirements
• The shipment destination is restricted

Brady’s Custom Arms reserves the right to refuse any transaction that raises compliance concerns.

5. Pricing and Availability

All firearm listings are subject to availability and pricing accuracy. In the event of a pricing error or inventory discrepancy, we reserve the right to cancel the order prior to shipment.

Prices do not include:

• Shipping charges
• Receiving FFL transfer fees
• Applicable taxes
• Compliance-related costs

Full payment must be received before shipment.

6. Condition of Firearms

Firearms may be sold as:

• New
• Used
• Custom-built

Used firearms are sold in their current condition unless otherwise stated. Customers are encouraged to inspect firearms at the receiving FFL prior to completing transfer.

Once a firearm is transferred, the sale is final.

7. Custom Firearms and Special Orders

Custom builds and special-order firearms require deposits. Once materials are ordered or work begins:

• Deposits are non-refundable
• Orders cannot be canceled
• Estimated timelines are subject to supplier availability

Custom firearms are built according to customer specifications and are non-returnable.

8. Assumption of Risk

Firearms are inherently dangerous when improperly handled. By purchasing a firearm from Brady’s Custom Arms, you acknowledge:

• You understand safe handling and storage practices
• You accept responsibility for lawful possession and use
• You will comply with all training, storage, and safety requirements

Brady’s Custom Arms is not responsible for misuse, negligence, or unlawful activity involving firearms after lawful transfer.

9. No Straw Purchases

You certify that you are the actual buyer of the firearm and are not purchasing on behalf of another individual who may be prohibited from ownership.

Straw purchases are illegal under federal law and will be refused.

10. Order Cancellation

Firearm orders may only be canceled prior to shipment and before FFL verification is complete. Once shipped, cancellation is not permitted.

If a cancellation is approved before shipment, administrative or restocking fees may apply.

11. Limitation of Liability

To the fullest extent permitted by law, Brady’s Custom Arms shall not be liable for:

• Regulatory denials
• Transfer delays
• Manufacturer defects
• Carrier shipping delays
• Customer misunderstanding of product specifications

All manufacturer warranties, if applicable, are provided by the original manufacturer.

12. Agreement Acknowledgment

By completing checkout, placing an order, or submitting payment for a firearm, you acknowledge that:

• You have read and understand this Firearms for Sale & Checkout Agreement
• You agree to comply with all applicable firearm laws
• You accept the refund and shipping policies associated with firearm transactions

If you do not agree with these terms, do not proceed with checkout.
